Welcome to Martini Moment Photo Booths (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website [martinimomentphotobooths.com] (“Site”) and our photo booth rental services (“Services”). By accessing our Site or booking with us, you agree to these Terms.
If you do not agree, please do not use our Site or Services.
1. Services
We provide luxury open-air DSLR photo booth rental experiences for weddings, corporate events, and special celebrations. Details of packages, pricing, and add-ons are listed on our Site or in your booking agreement.
2. Bookings & Payments
A signed agreement and non-refundable retainer are required to secure your event date. Remaining balances are due no later than 30 days before the event, unless otherwise stated in your invoice. Failure to pay on time may result in cancellation of your booking.
3. Cancellations & Refunds
Retainers are non-refundable. If you cancel at least 30 days before your event, you may apply your retainer toward a future booking within 12 months.
Cancellations within 30 days of your event are non-refundable. If we must cancel due to unforeseen circumstances (e.g., equipment failure, illness, emergencies), you will receive a full refund of all payments made, including your retainer.
4. Event Requirements
Clients are responsible for providing:
Adequate space, power source, and venue access for setup and operation of the booth.
Coverage from weather conditions if the event is outdoors.
We reserve the right to stop or deny service if conditions are unsafe or unsuitable.
We require adequate setup time prior to the event start. Delays caused by venue access, vendor timing, or client coordination may reduce service time and will not result in a refund.
5. Photo Usage & Ownership
The client grants Martini Moment Photo Booths permission to capture and use photos and videos from the event for promotional purposes, including marketing, website, and social media.
The client is responsible for informing guests that photography and photo booth services will be present at the event.
If any guest prefers not to be photographed or have their images used, it is the client’s responsibility to notify us in advance.
6. Conduct
The client is responsible for the behavior of guests using the booth. We are not liable for damages caused by misuse, intoxication, or neglect. If guests act in a way that endangers our staff or equipment, service may be stopped without refund. The client agrees to be responsible for any damage to equipment caused by guests. Repair or replacement costs may be billed accordingly.
7. Liability
We are not liable for any indirect, incidental, or consequential damages arising from the use of our Services. Our maximum liability is limited to the total amount paid for your booking.
8. Website Use
By using our Site, you agree not to:
Copy or misuse any content, images, or branding.
Attempt to interfere with security features or the operation of the Site.
9. Privacy
We respect your privacy. Please review our Privacy Policy for information on how we collect, use, and protect your data.
10. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in courts located in Pueblo County, Colorado.
11. Updates
We may update these Terms from time to time. Continued use of our Site or Services means you accept any changes.
By booking with Martini Moment Photo Booths, you acknowledge that you have read and agree to these Terms.
